By placing an order with Gymless, you agree to these Terms together with any policies referred to below.
1. About These Terms
These Terms apply to orders placed through our website and, where applicable, orders arranged directly with Gymless.
If you are purchasing as a consumer, nothing in these Terms limits or removes any rights available to you under applicable Irish consumer law.
If you are purchasing wholly or mainly for business, trade, professional or commercial purposes, statutory rights applying specifically to consumers may not apply to your purchase.
2. Products
We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, weights and other information shown on our website are accurate.
Product photographs are for illustration purposes. Minor variations in colour, finish, packaging or appearance may occur between production batches and do not necessarily constitute a defect.
Any stated dimensions, capacities, product weights or similar specifications may be subject to normal manufacturing tolerances.
Where a particular specification, dimension or feature is essential to your intended use, please contact us before ordering.
Products must only be assembled, installed and used in accordance with the manufacturer's or supplier's instructions and any stated maximum load or usage limits.
Commercial suitability only applies where a product is specifically described as being suitable for commercial use.
3. Prices
Prices displayed on our website are in euro and include VAT where applicable unless clearly stated otherwise.
Delivery charges are shown separately where applicable and will be displayed before completion of checkout.
We make every reasonable effort to ensure that prices are correct.
If an obvious pricing or listing error is identified before an order has been accepted, we may contact you and give you the opportunity to proceed at the correct price or cancel the order for a full refund.
4. Placing an Order
When you place an order, you are making an offer to purchase the products included in that order.
An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been accepted.
An order is accepted when we confirm that it has been dispatched, made available for collection, or otherwise expressly accepted by Gymless.
We may decline an order before acceptance where, for example:
• A product is unavailable.
• There has been an obvious pricing or product-information error.
• Payment has not been authorised.
• We reasonably suspect fraudulent or unauthorised activity.
• We cannot deliver the order to the address provided.
If payment has already been taken for an order that we cannot accept, the relevant amount will be refunded.
5. Payment
Payment must be made using one of the payment methods offered at checkout unless another arrangement has been agreed with Gymless.
You must have authority to use the payment method supplied.
Orders may be held until payment has been successfully received or authorised.
6. Availability and Lead Times
All products are subject to availability.
Stock information is updated regularly, but occasionally an item may become unavailable after an order has been placed.
If this happens, we will contact you and, depending on the circumstances, may offer an alternative product, revised lead time or refund.
Where a product is specifically shown as being supplied to order, directly from a distributor or manufacturer, or with a stated lead time, that information forms part of the product listing.
7. Delivery
Delivery information, estimated delivery times and applicable charges are set out in our Shipping Policy and on relevant product pages.
Delivery times are estimates unless we expressly agree a guaranteed delivery date.
Some gym and fitness equipment is large, heavy or palletised and requires specialist transport.
Where an order is described as kerbside delivery, the carrier is not required to bring the goods inside a building, upstairs, into a gym, garage or other final installation location.
You are responsible for ensuring that suitable access is available and that adequate assistance is present to safely move heavy goods from the delivery point where necessary.
Please ensure that the delivery address and contact information supplied with your order are correct.
If you notice visible transport damage, missing packages or another delivery issue, please contact us as soon as reasonably possible.
Prompt notification helps us investigate the matter with the carrier but does not remove any statutory rights you may have.
8. Click & Collect
Click & Collect orders may only be collected once you have received confirmation that the order is ready.
Collections must take place during the designated collection hours published by Gymless.
Please do not travel to the warehouse before receiving confirmation that your order is ready.
Orders that remain uncollected beyond the stated holding period may be cancelled and refunded.
9. Cancelling an Online Order
Consumers purchasing online generally have a statutory cancellation period following receipt of the goods, subject to statutory exceptions.
Full details of cancellation rights, return deadlines, return conditions and return costs are contained in our Returns & Refunds Policy, which forms part of these Terms.
10. Returns
All returns must comply with our Returns & Refunds Policy.
Where a customer arranges their own return delivery, the return must be delivered directly to the Gymless business premises at the return address stated in that policy.
Gymless does not collect customer-arranged returns from post offices, courier depots, parcel lockers or third-party collection points unless we have specifically agreed or arranged that return method.
A parcel being held by a carrier at another location for collection does not constitute delivery of the return to Gymless.
This does not affect your statutory rights or returns where Gymless has arranged collection.
11. Condition of Change-of-Mind Returns
Consumers are entitled to inspect goods to establish their nature, characteristics and functioning.
Where goods have been handled beyond what is reasonably necessary for such inspection and their value has been reduced, a deduction may be made from the refund where permitted by law.
Gym equipment that has been assembled, installed, loaded with weights, exercised on, damaged, marked, scratched, returned incomplete or otherwise handled beyond what is reasonably necessary for inspection may have suffered a reduction in value.

12. Faulty, Damaged or Incorrect Goods
Your rights relating to faulty goods are separate from your right to change your mind.
Goods supplied by Gymless must comply with applicable Irish consumer law.
Depending on the circumstances, statutory remedies may include repair, replacement, price reduction or refund.
If you believe an item is faulty, damaged or incorrect, contact us and provide details of the problem together with photographs or other information reasonably required to assess the issue.
Where goods are faulty and the customer has a statutory right to return them, applicable return costs will be handled in accordance with consumer law.
13. Manufacturer Warranties
Some products may include a manufacturer's warranty or guarantee.
Any manufacturer warranty is additional to your statutory rights and does not replace or reduce those rights.
Warranty terms may vary between manufacturers and between domestic and commercial use.
14. Assembly and Safe Use
Gym and fitness equipment can be heavy and may present a risk of injury if incorrectly assembled, installed or used.
You are responsible for following all assembly, installation, maintenance and operating instructions supplied with the product.
Where appropriate, equipment should be securely anchored or installed by a competent person.
Products must not be used beyond stated weight capacities or for purposes for which they were not designed.
This section does not exclude responsibility for defective products or any liability that cannot legally be excluded.
15. Website Information
We may update, correct or change website content from time to time.
Changes to general website content will not retrospectively alter an order that has already been accepted unless agreed with you or required by law.
We cannot guarantee that the website will always be available without interruption, although we aim to maintain reliable access.
16. Promotions and Discount Codes
Promotions, discount codes and special offers may have additional conditions, including expiry dates, excluded products, excluded brands, minimum order values or other limitations.
Unless expressly stated otherwise, promotional offers cannot be combined.
We may withdraw or correct a promotion where there has been an obvious error, misuse or technical malfunction, subject to applicable law and any order already validly accepted.
17. Intellectual Property
The content of https://www.gymless.ie, including text, photographs, graphics, branding, logos and website material owned by Gymless, may not be reproduced, republished or commercially exploited without permission.
Third-party trademarks and product imagery remain the property of their respective owners.
18. Acceptable Use of the Website
You must not use our website:
• For unlawful or fraudulent purposes.
• To interfere with the operation or security of the website.
• To introduce malicious software or harmful code.
• To attempt unauthorised access to our systems or data.
• To misuse website content or intellectual property.
19. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful or where liability cannot legally be excluded.
Nothing in these Terms excludes or limits liability for death or personal injury where such liability cannot legally be excluded.
We are not responsible for loss or damage resulting from misuse, accidental damage, normal wear and tear, failure to follow instructions, unauthorised modification or use of products beyond their specified limits, except where responsibility remains with us under applicable law.
20. Events Outside Our Reasonable Control
Occasionally delivery or performance may be delayed by events outside our reasonable control, including severe weather, transport disruption, carrier failures, industrial action, supply-chain disruption or other exceptional events.
If such an event materially affects your order, we will take reasonable steps to minimise the effect and will contact you where appropriate.
Nothing in this section removes any statutory right you may have to cancel or obtain a refund where applicable.
21. Personal Information
Personal information is handled in accordance with our Privacy Policy.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, website, services or applicable law.
The Terms applying to an order are those in effect when the relevant contract is entered into, unless a later change is required by law or expressly agreed with you.
23. Governing Law
These Terms and contracts between you and Gymless are governed by the laws of the Republic of Ireland.
Any dispute will be subject to the jurisdiction of the Irish courts, subject to any mandatory consumer rights regarding jurisdiction that apply.
